See FM 27-10 for "jus feciale", not jus gentium or natural law.

For 'customary laws of war' on military tribunals, see Johnson v. Eigentrager. Remember that many of your law professors are practioners of "private international law", not the more pertinent "international public law" of military tribunals for enemy aliens abroad. It has always been the more widely recognized and established "universal jurisdiction" of the Laws of Land Warfare.

Ask your professors if they even have any type of military legal experience in the catastrophic event that they find your opinion not be politically correct when they flunk you.
