Re: Is the present military action against the Taleban and the AL Qaeda network in Afghanistan lawful?Posted by Jeff Geer on June 22, 2002 at 03:05:28: In Reply to: Is the present military action against the Taleban and the AL Qaeda network in Afghanistan lawful? posted by Miriam Hall on June 19, 2002 at 10:38:04: Article 51 of the UN Charter is a voluntary obligation upon its members and is not a treaty nor an organic act of supra-national juridical person. Article 5 of NATO is binding within the Laws of War, so get out your US Army Field Manual 27-10 Laws of Land Warfare and see how reprisals against detained protected persons (eg. "unlawful combatants") is thus potentially allowed for the lawful contravening of the Geneva Convention. These combatants brutally attacked a civilian target with massive causalties in a violation of the Laws of War, so brutal reprisals against these uncivilized terrorists are theorectically authorized until their global eradication. So argue your UN Charter case within the law-making treaties, if you want some stronger legal soundbites of a self-defense argument.
