5. Conclusion

The Appellate Body finds inconsistent facial "ordinary meanings," justifying its turn to other devices for interpretation under articles 31 and 32 of the Vienna Convention.

This case was occasioned by imprecise drafting of the WTO agreements. In ideal negotiating circumstances, greater precision would preclude disputes such as this. It was necessary in this case for the Panel and the Appellate Body to "clean up" the drafting, based on a relatively thin basis for determining the intent of the parties.
