2. Facts

The original panel had found that TPC provided export subsidies to the Canadian regional aircraft industry. The Article 21.5 Panel found that Canada had withdrawn these particular measures. Canada revised the TPC's criteria so that they were no longer contingent on exports, but required instead that the recipients of the subsidy be export-oriented.
