1. Abstract

This decision examined the scope of the obligations under Article XVII of GATT 1994, relating to state trading entities (“STEs”). It addressed the question of whether the GATT disciplines on STEs require STEs to act in a completely commercial manner, or whether the requirements in Article XVII(1)(b) are more limited. The Appellate Body found that the obligations contained in Article XVII(1)(b) are dependent on those in Article XVII(1)(a), and therefore the obligation to make purchases or sales solely in accordance with commercial considerations is intended to prevent discrimination.
